Definitions
In these terms and conditions and privacy policy, the following words shall have the meanings given in this section:

"Contract" means either (a) the set of web pages completed by the you, which provide details of goods required, the delivery address provided by you, payment card details, etc, and which incorporate the terms and conditions set out herein, and is concluded by us despatching the goods to you, or (b) if the order is taken on the telephone, the contract is concluded by us despatching the goods to you;

"'Goods" means any goods and/or material supplied by us to you and available for sale on this website or at our shop.

"Strictly Knitting", "Us" or "We" means Antonia and Stephen de Boise trading as Strictly Knitting of 61 Regent Street, Shanklin, Isle of Wight, PO7 7AE.

"'Rights" means all copyright, design rights (whether registered or unregistered), patents, rights in trade marks (whether registered or unregistered), database rights or other intellectual property rights in this website and the goods, for the full term of those rights, worldwide.

"'You" means the person, firm or company placing the order in the terms set out herein

Agreement
This agreement applies as between you, the User of this website and Strictly Knitting, the owner(s) of this website. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the website. If you do not agree to be bound by these terms and conditions, you should stop using the website immediately.

Delivery area
Currently Strictly Knitting is only able to deliver orders to UK addresses.

Age restrictions
Persons under the age of 18 should only use this website under the supervision of an adult. Payment information must be provided by or with the permission of an adult.

Product descriptions
All information on our online shop is accurate to the best of our knowledge. However, we cannot guarantee that all product descriptions are current and free from error, where errors are identified we will correct these as soon as possible after they are brought to our attention.

Due to variations in which computer screens display colours, the colour displayed on your screen may not match the actual colour of the yarn, colour names and swatches are for your convenience only.

All pricing information on the website is correct at the time of going online. Although we endeavour to stabilise prices we reserve the right to change prices, alter and/or remove any special offers from time to time and as necessary.

The contractual offer
No part of this website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and our acceptance of that offer is deemed to occur upon our sending a dispatch email to you indicating that your order has been fulfilled and is on its way to you.

Cancellation
We reserve the right to cancel the contract with you if:

(a) you request an order to be delivered to a location outside of the UK
(b) we do not deliver to your UK area
(c) we have insufficient stock to deliver the goods you have ordered
(d) one or more goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

If we cancel the contract we will notify you by email and will re-credit to your account any sum deducted via WorldPay from your credit/debit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

Your right to cancel
You have the right to cancel your order any time up to and including seven days after delivery. Notice of cancelation cannot be accepted by phone unless backed up in writing as above with no refund made until this has been recieved.

Other than the cancelation of an order due to receipt of damaged goods (see below) you will be responsible for the original shipping costs, and the cost of returning the goods. See Returning goods below.

For a full refund of the value of the goods, the goods must be returned unopened and in a re-saleable condition, as new and without any additional work required on the part of Strictly Knitting to make them resalable.

We will re-credit to your account any such sums due via WorldPay to your credit/debit card account as soon as possible but in any event within 30 days of the receipt of the goods.

Strictly Knitting reserves the right to exercise discretion with respect to any returns under these terms and conditions.

Orders that are out of stock
In the event that we do not have sufficient stock to complete your order, we will email or phone to advise you. You then have the option to put it on back order, complete it in part or cancel in full.

Damaged goods
In the unlikely event of goods being received in a damaged condition at the delivery address, provided you notify us within seven days of delivery we will happily reimburse any postage cost incurred for the return of the damaged goods and will send replacement goods at no further cost to you.

However all damaged goods must be returned as below and must include a note giving a description of the damage.

Failure to notify us within seven days of delivery will result in the goods being deemed to be in accordance with these terms and conditions and you will be deemed to have accepted the goods and to be liable to pay for all and any charges therefor.

Returning goods

We cannot accept liability for returned goods lost or damaged during transit. You are therefore advised to wrap the goods carefully to avoid damage or further damage if returning damaged goods. You are also advised to return all goods by Royal Mail signed for, recorded delivery or registered post you should also consider checking the value of the goods against the insured value of the postal service being used and top up if necessary. Proof of postage will not be accepted as proof of delivery.

Please remember in the case of returning damaged goods to provide a description of the damage and in all cases to give us your name, address, and a copy of your purchase receipt.

Other than the return of damaged goods, the cost of returning goods will be borne by you. Damaged goods should whether possible be returned by Royal Mail, goods up to 4kg via Royal Mail first class post, goods over 4kg by Royal Mail Standard Parcels service.

Making payments & card security
Goods online are required to be paid for by a credit or debit card via WorldPay which our website will direct you to upon completion of your Shopping Cart. WorldPay will process your payment securely with the highest level of card data security (currently PCI DSS Level 1 compliant).

Please note we cannot accept online payment via PayPal or other third parties nor can we redeem Strictly Knitting gift vouchers online. Gift vouchers may be redeemed via telephone orders or by mail order however the order will not be processed until the voucher is mailed to us and received.

Cheques - due to the end of the UK Domestic Cheque Guarantee Card Scheme we can no longer accept cheques in payment for orders.

If you are shopping from outside the UK be aware that we only accept payment in UK Sterling and that delivery must be to a UK only address, your credit/debit card company will convert the transaction to your own currency for which they may make a charge.

VAT
VAT will be added and shown on your invoice, where applicable for the total cost (goods plus postage) as required by UK law.

Despatch & carriage charges
We aim to despatch goods that are in stock within 2 to 3 working days with any delays being notified via email or telephone. All goods will be sent via Royal Mail at cost price dependant on the weight of the order which will be calculated at checkout (VAT where applicable will be added and shown on your invoice) we do not make any additional charge for packaging or labour.

Deliveries up to 4kg are made using Royal Mail first class post, deliveries over 4kg are sent by Royal Mail Standard Parcels service.

All goods ordered will be delivered to the UK address you give at the time you make the order. However we reserve the right to withhold delivery to any particular place or location at our sole discretion in this event we shall notify you by email or telephone giving you the option to cancel the order or agree an alternative delivery place/location at your own risk.

The risk in delivery of the goods passes to you on commencement of the supply or transit, and remains with you should the goods not be accept on the date of delivery and transferred to temporary storage arranged by us or the postal / courier service making the delivery.

Changes to terms & conditions
If Strictly Knitting is required to make any changes to terms and conditions relating to sale of goods by law, these changes will apply automatically to any orders currently pending in addition to any orders placed by you in the future, furthermore Strictly Knitting reserves the right to change the website, its content or these terms and conditions at any time. You will be bound by any changes to these terms and conditions from the first time you use the website following the changes.

We may change the website and correct, or update, information (including product information) at any time, without prior notice.

Website use
You access our website entirely at your own risk it is provided "as is" and on an "as available" basis. Strictly Knitting does not represent or warrant that the material contained herein, any of the functions of the website and the server will operate without interruption or delay or will be error-free, free of any defects, viruses or bugs or compatible with any other software or material.

To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.

We accept no liability for any disruption or non-availability of the website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

You must not transmit through, or to, our website any material which is defamatory, distressing, harmful, obscene, pornographic, threatening or material that might infringe upon the rights of others (including intellectual property rights, rights of confidentiality or rights of privacy) or material which does not comply with all relevant laws.

No part of this website is intended to constitute a contractual offer capable of acceptance nor does it constitute advice and should not be relied upon when making any decisions or taking any action of any kind.

Limitation of Liability
To the maximum extent permitted by law, we accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the website or any information contained therein. Users should be aware that they use the website and its content at their own risk.

Nothing in these terms and conditions excludes or restricts our liability for death or personal injury resulting from any negligence or fraud on the part of Strictly Knitting.

Nothing in these terms and conditions excludes or restricts Strictly Knitting's liability for any direct or indirect loss or damage arising out of the incorrect delivery of goods or out of reliance on incorrect information included on the website.

Whilst every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.

No Waiver
In the event that any party to these terms and conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

Third party rights
A person who is not a party to this contract has no rights under the Contracts (Rights of Third Parties) Act of 1999 to enforce any term of this contract, but this does not affect any other right or remedy of a third party.

Law and Jurisdiction
These terms and conditions and the relationship between you and Strictly Knitting shall be governed by and construed in accordance with the Law of England and Wales and Strictly Knitting and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full before 6pm on a business day and on the next business day if the email is sent on a weekend or public holiday.

Subject to the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 and the exceptions given in the section headed 'Links to other websites' in these terms and conditions, all content included on the website, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Strictly Knitting, our affiliates or other relevant third parties. By continuing to use the website you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws.

Cookies & privacy
Cookies are small text files that are placed on your device by websites that you visit. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site; Strictly Knitting does not use cookies in this way.

Software used by Strictly Knitting does however collect information from uses as explained below.

Our web site is powered by Joomla which records anonymously the number of visits made to our pages.

Our online shop uses the HikaShop plugin software which collects and stores data input by users in carrying out sales transactions this includes, name, email address, home and delivery address, telephone number along with details of purchases made. Other than in the pursuance of finalising these sales transactions Strictly Knitting will not use this data to market goods beyond the initial purchase nor will we, unless obliged or permitted by law to do so, disclose this data to third parties. Should this policy change we will endeavour to inform you in advance of such use giving you the opportunity to have your data deleted.
